JobFact is committed to protecting the privacy of our users, and strives to provide a safe, secure user experience. This Privacy Policy sets forth the online data collection and usage policies and practices that apply to JobFact's web site. RH SAS ("JobFact", "we", or "us") takes the privacy and protection of personal Information very seriously. By visiting the site, registering as a Member, or using the services, you acknowledge and accept the practices and policies outlined in this privacy policy ("Privacy Policy"). Unless otherwise defined herein, capitalised terms shall have the meanings assigned to such terms in the JobFact Terms of Use, which can be found at http://www.jobfact.com/en/pages/terms-of-use.html and which incorporate this Privacy Policy by reference.

By using the services or submitting Personal Information through the services, you expressly consent to the processing of your Personal Information according to this Privacy Policy.

Your Personal Information may be processed in the country where it was collected as well as other countries where laws regarding processing of Personal Information may be less stringent than the laws in your country.

Personal Information We Collect and retain

Personal information is information that can be used to identify you, or any other individual to whom the information may relate, personally. We do not collect personal information unless you choose to provide it to us:

Our Member registration process to create an Account requires you to provide us with a username, your e-mail address, and password of your choice. Furthermore, you have to provide either an employer review or salary report to become a Member.
When you contribute company reviews or salary reports or provide any other Content to the services through other means, we will collect all the information you provide.
When you contact us by sending us an e-mail or when you use any of our contact forms, we will collect any information that is contained in (and/or attached to) your e-mail, text message, or that you enter into such forms.
We also collect behavioural information regarding how you use our sites, the areas of our site that you visit, what services you access, and information about your computer hardware and software including your IP address, geolocation, browser and operating system type, access times and referring Web site addresses. This information is necessary for analysing the use of resources, troubleshooting problems, preventing fraud, and improving our services.

Use of Cookies and technology to collect personal information

As you use the services, certain information may also be collected passively, including your Internet protocol (IP) address and the browser that you use to visit the site. JobFact also stores a small text file called a "Cookie" on your computer to store your login information (if any) and your personal preferences for the services. JobFact may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them). While you will still be able to use the services if you disable Cookies in your browser, certain parts of the services may not function as effectively. After you register and enable Cookies, we may associate this information with Personal Information that we have collected from you.

Personal Information from Other Sources

We may receive Personal Information about you from outside the site, such as telephone, fax, mail, or from third parties that provide services for us that are related to the services. We may add this information to the information we have already collected from you via our services.

How Collected Information is used

We use the information we gather on the web site for the purposes of providing you and other users with our services, responding to any queries you may have, operating and improving the web site, fostering a positive user experience and delivering the products and services that we offer to members, jobseekers and employers. Our services include the display of personalised products, content, and advertising relating to your profile and interests. The information we gather on any JobFact web site may be shared within JobFact group of companies & websites on a worldwide basis, including countries that might not have legislation that guarantees adequate protection with respect to your country of residence, in order to deliver these products and services.

By registering with JobFact, by managing your profile, or expressly opting in when presented with choices, you have consented for us to use your information, subject to local law, in the following ways:

  • to allow you to create an account;
  • to create a profile for you based on information that you have provided to us;
  • when publishing a review and/or a salary, automatically create an anonymous cv, that you can delete afterwards by sending an email to publications@jobfact.com ;
  • to contact you about JobFact Site updates, informational and service-related communications, including important security updates;
  • to provide you additional communications, information, and promotions such as newsletters and career advice;
  • to inform you of other products or services available from JobFact or its Affiliates;
  • to enable you to provide feedback, to contact us and for us to respond to you;
  • to conduct surveys, questionnaires, promotions and contests, and to provide the results thereof such as success stories and contest winners;
  • to provide products and services to employer customers to complete the recruitment and hiring process, such as accessing the searchable anonymous resume database but never accessing to any of your personal contact details (email, username, etc...);
  • to provide products and services that enable users to network, post information on bulletin boards, view and compare anonymous profiles, and years of experience;
  • to generate internal reports about the use of our site;
  • to provide ‘forward to a friend' features;
  • to use anonymously your published data to create data statistics reports for employer customers; and
  • to use your anonymous Personal Information to target advertisements to your anonymous profile on our website only.

Some of our products and services, such as our searchable anonymous resume database and networking, enable third parties to see your anonymous personal information and to contact you on your JobFact mailbox. Anonymous Profile information will not be visible to your current employer and employers you have blocked.

We attempt to limit access to our searchable anonymous proprietary CV database system to legitimate users such as paying employers, recruiters, hiring managers, headhunters and human resource professionals, as well as law enforcement and national security agencies, but cannot guarantee that other parties will not gain access to this database. We cannot control the use made of CVs by third parties who access such anonymous CVs while they are in our searchable database. You may remove your anonymous CV from our searchable database at any time; details of how to do this are given below. However, employers, recruiters and others who have paid for our services related to database access, as well as parties who have otherwise gained access to the database may have retained a copy of your anonymous CV in their own files or databases. We cannot control the retention, use or privacy of anonymous CVs or anonymous profiles that have been downloaded by third parties. Accordingly, you should not put sensitive information, personality profiles, or other information you would not want made public, in your anonymous CV.

If you choose to use our service to tell a friend about our site, we will ask you for your friend's email address. We will automatically send your friend a one-time email inviting him or her to visit the site. We store this information for the sole purpose of sending this one-time email and ensuring multiple invitations are not sent. Your friend may contact us at publications@jobfact.com to request that we remove this information from our database.

Information you post in public areas of the site or placed in the searchable anonymous CV database will be accessed, used, and stored by others around the world, including countries that might not have legislation that guarantees adequate protection with respect to your country of residence. By providing your personal information for inclusion in our database, you acknowledge that you consent to your information being used as described here. While JobFact takes measures to safeguard your information from unauthorized access or inappropriate use by third parties, JobFact does not control these third parties and we are not responsible for their use of information you post or otherwise make available in public areas of the JobFact Sites. Accordingly, you should ensure that you do not post sensitive information, including personality profiles, to any JobFact Site.

Information publically posted

One of the purposes of the services is for Members to share employment-related information with other Users. Therefore, you should assume that any information (including any Personal Information you may choose to provide, but excluding your registration information) that you post will be made available to other Users of the services. We may provide you the ability to anonymously post certain comments, in which case we will not include your contact information (i.e., job position, username...) on the site in connection with such comments. However, you should know that our internal records may associate your contact information with such comments.

We cannot control the use made by third parties of information you post or otherwise make available in public areas of JobFact.

Access to Personal Information

Our website conforms to the principles set out in article 34 de la loi N• 78-17 du 6 Janvier 1978 relative à l'informatique, aux fichiers et aux libertés. You have the right to access, modify or delete any information submitted by you to JobFact. You may do this by writing to: publications@jobfact.com.

We will send you a copy of all the available Personal Information that we have within one month. In order to process your request, we may ask you for identification. The information will be sent to you at no cost.

You may request that we:

Delete the information,
Rectify or modify the information,
Add to the information.
We reserve the right to refuse to release your personal data, depending on the facts of the situation. We will give reasons for our refusal.

Feedback

If you provide feedback about the services to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information. We will collect any information contained in the feedback and will treat the Personal Information in it in accordance with this Privacy Policy.

Disclosure of Personal Information to others

Except as otherwise stated in this Privacy Policy, we do not disclose to or share your Personal Information with third parties, except with third parties who help us in the delivery of our own products and services to you. We disclose information to companies and individuals we employ to perform functions on our behalf. Examples include hosting our web servers, analysing data, providing marketing assistance, processing credit card payments, and providing customer service. These companies and individuals may be located in a country whose data protection legislation is different from your country, and they will have access to your Personal Information as necessary to perform their functions, but they may not share that information with any other third party or use that data for any other purpose.

We may provide your Personal Information to third party service providers and suppliers who work on behalf of or with us to provide you with some of the services and features of the services and to help us communicate with our Users. However, these service providers and suppliers do not have any independent right to use this information except to help us provide the services.

We may share some or all of your Personal Information with any of our Affiliates, in which case we will require our Affiliates to honour this Privacy Policy.

In the event JobFact goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Information will likely be among the assets transferred. You acknowledge that such transfers may occur, and that any acquirer of JobFact or its assets may continue to use your Personal Information as set forth in this Privacy Policy.

We may (and you authorise us to) disclose information we have collected from and about you (including Personal Information) if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on us; (b) to enforce our JobFact Terms of Use and Privacy Policy; or (c) to protect and defend the rights or property of us, the users of our services, or third parties.

Choices Regarding Personal Information

You may have access to, review, correct, update, change or delete your account profile information or anonymous CV at any time. Simply log into your account, go to your profile or anonymous CV, and make the necessary changes.

We may send you service-related announcements when we believe it is necessary to do so.

You may request that your Account be terminated and that your Personal Information be deleted by sending an email to publications@JobFact.com. Any termination of your account may involve deletion of your Account information from our live databases and all the information and data stored for such Account in the services. JobFact will not have any liability whatsoever to you for any termination of your account or related deletion of you information.

When we delete Personal Information that we have collected from or about you, it will be deleted from our active databases but may remain in our archives.

We may send newsletters or promotional communications to our Users. To unsubscribe to these communications you will be required to click an "Unsubscribe" link in these emails and confirm the email address for which you would like to unsubscribe.

If you previously opted to receive newsletters, commercial e-mails or other communications from JobFact, but subsequently change your mind, you may opt-out by editing your account profile as described above. If you previously opted not to receive such communications, you may later opt-in by editing your Account profile.

The services may contain links to other web sites that are not owned or controlled by JobFact. The provision of such links is for your convenience and does not signify our endorsement of such web sites or location or its contents. We have no control over, do not review and are not responsible for the privacy policies of or content displayed on such other web sites. Please be aware that the terms of our Privacy Policy do not apply to any outside web sites.

Advertising Servers

We may allow advertisers to place advertisements on the site. Clicking on such advertisements will direct you to the website of a third party. The third-party ad server may use Cookies or web beacons in connection with their advertisements on our site. This Privacy Policy does not cover the collection of information by these third-party ad servers through the use of Cookies, web beacons, or other means.

Privacy of Children

Jobfact is not intended for, nor do we knowingly collect information from, children under the age of 18.

Security and Confidentiality

You are responsible for ensuring that your log-in credentials (your username and password) are kept confidential.

JobFact has put in place technical and organisational measures designed to secure your Personal Information we collect online from accidental loss and from unauthorised access, use, alteration or disclosure. However, no company, including JobFact, can fully protect against the security risks associated with Personal Information.

Each of our employees and subcontractors who have access to our data is contractually bound to comply with this Privacy Policy.

Changes to This Privacy Policy

As part of the JobFact Terms of Use, this Privacy Policy is likely to be subject to periodic amendment, in accordance with the terms of the JobFact Terms of Use.

If we decide to change our privacy and security policy, we will update the date upon which this policy, including those changes became effective from at the top of this policy and post a prominent notice on our homepage, so that you will always know what information we gather, how we might use that information, and to whom we will disclose it.

We reserve the right to modify this policy at any time, so please review it frequently.
